Greetings fellow pot activists
As many of you already know, after smoking pot in front of police in Ottawa, Hamilton, Toronto, Pembroke, and in public everywhere since the Summer of legalization, I was arrested in my own town of Barry`s Bay, on August 1st 2004.
I remember thinking at the time, the Police must have been given a new directive, that is to start once again, arresting all public pot smokers.Since then the number of people arrested for posession seems to have skyrocketed. With many of the people I`ve talked to simply pleading guilty, I thought it was time to remind everyone that we should be trying to make this and any new directive, fail miserably.By contesting every single posession charge we will force them to rethink their strategy. Please remind your friends to plead NOT GUILTY and fight for as long as they feel comfortable, representing themselves if need be, but see it through until they are found guilty by the court.
Let`s clog the courts with these posession charges to ensure this new directive fails miserably.
I will be fighting my charges all the way to the Supreme Court of Canada, unless they find a reason to dismiss, which they`ve left lots of opportunities to do, if they do dismiss I will be back in their faces in public.
My Constitutional Question revolves around whether or not
I can smoke for prevention, as opposed to "recreationally"In other
words what gives them the right to call what we do "recreational smoking."
I call it preventative medicine. Why must we first be to be diagnosed with
a terminal illness, try all the toxic synthetic pharmaceuticals, before
we can take advantage of the acknowledged medicinal benefits of pot? This
argument falls somewhere between R v Parker and R v Malmo-Levine et,al.
(David if you read this I`d like to get some pointers re: self representation
at that level)
I would also like to bring attention to and support the constitutional question
being raised by Marco Ivencevic regarding the very existence of the mechanism
that alledgedly allowed the Ontario Court of Appeal to change law that has
been "of no force or effect" for almost two years, and reinstate
it from coast to coast.
I, and I`m sure many others have e-mailed Justice Minister Irwin Cottler, with this very question back in August, of course with no reply.
