Operation Jackpot - Judge renders decision on charter

A provincial court judge has ruled David Black's charter rights were not violated during the police investigation.
Judge Sylvio Savoie read his decision in court on Thursday, Dec. 20.
Black's defence lawyer on the motions only, Peter Mockler, presented arguments on the motion on Nov. 19, as well as arguments challenging the wiretap authorizations. Savoie will issue his ruling on that argument Jan. 29.
Black goes on trial on charges of conspiracy to produce and conspiracy to traffic in marijuana on March 17. The trial is expected to last four weeks. Black, 47, is planning to defend himself during the trial.
Defence lawyers for Kevin Black and Matt Amos, along with federal crown prosecutors, are awaiting Justice Stephen McNally's decision on the same arguments. No date has been set for that decision. The defence lawyer for Robin Charest did not present arguments on the motion.
Kevin Black and Charest face joint charges of conspiracy to produce and conspiracy to traffic in marijuana. Amos faces charges of conspiracy to traffic and conspiracy to export.
All were charged jointly with Paul Black. His charges have been severed from the others. The 54-year-old will appear for Motions Day in Court of Queen's Bench on Jan. 7 to confirm trial dates that were scheduled for June. His defence lawyer, Danielle Bastarache, has requested an adjournment.
Black faces charges of conspiracy to produce and conspiracy to traffic in marijuana. He also faces charges of conspiracy to traffic in marijuana, cocaine, methaphetamine, Ecstasy, oxycodone and conspiracy to export oxycodone.
All charges are related to , an 18-month police investigation that involved
the Miramichi Police Force and RCMP. The investigation culminated in a
takedown on April 19, 2005. On that date, police uncovered 14 hydroponic
grow operations and over three dozen people were arrested.
